Terms of Service for Ag Help Ltd.

Welcome to Ag Help Ltd. These Terms of Service ("Terms") govern your access to and use of the Ag Help Ltd mobile application and website (the "Service"), operated by Ag Help LTD ("us," "we," or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
1. Description of Service
Ag Help Ltd is a digital marketplace platform that connects agricultural producers with independent contractors and owners of available machinery. Ag Help Ltd facilitates communication, location-based matching, and service requests but does not provide agricultural labor or equipment directly.
2. User Eligibility and Accounts
Account Creation: You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your login credentials.
Accuracy: You agree to provide accurate, current, and complete information during the registration process.
Verification: While Ag Help Ltd may provide tools for user communication, we do not verify the professional credentials, insurance, or legal standing of users. It is your responsibility to vet any party you engage with through the App.
3. User Conduct and Safety
Equipment Safety: Owners listing machinery represent that all equipment is in safe, operable condition and meets Saskatchewan provincial safety standards.
Competency: Contractors represent that they possess the necessary skills, licenses, and physical ability to perform the services they offer.
The "Panic Button": The panic button feature is intended for agricultural assistance and service recovery. It is NOT a substitute for emergency services (911). In the event of a medical emergency or fire, call 911 immediately.
4. Relationship of Parties
Ag Help Ltd is a platform provider only. No agency, partnership, joint venture, or employment relationship is created as a result of these Terms or your use of the Service.
Independent Contractors: Contractors are independent business entities and are not employees or agents of Ag Help Ltd.
Liability for Services: Ag Help Ltd is not responsible for the quality, timing, legality, or failure of any services or machinery provided by users.
5. Limitation of Liability
To the maximum extent permitted by law, Ag Help Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
Loss of profits, crops, or data.
Personal injury or property damage resulting from the use of machinery or services coordinated through the App.
Mechanical failure of equipment rented or shared through the platform.
All transactions and agreements made between users are at their own risk.
6. Payments and SMS Fees
Service Fees: AgHelp reserves the right to charge fees for platform access or successful connections.
SMS Charges: AgHelp uses Twilio to facilitate communication. Standard message and data rates from your carrier may apply.
7. Termination
We reserve the right to terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users of the Service or us.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of the Province of Saskatchewan and the federal laws of Canada.
